Comments from Dept of Environmental Conservation: A public hearing held on 12/15/10 took comments on Beaver Wood Energy's application for a permit for groundwater withdrawal. Several questions were posed at that time and during the comment period (ending 1/15/11). Responses from DEC are now linked here and available at the Town Clerk's Office. BWE makes copies of its permit applications available here.

Party Status: The Public Service Board has issued a new order (1/19/11) granting a range of groups the right to intervene in the Beaver Wood Energy permitting request. Out of state groups, including Berkshire Regional Planning Commission, Williams College, and Williamstown, MA, all received permission. Read the full decision online

Schedule for Deciding Jurisdiction: The first step in the permitting process for Beaver Wood Energy (BWE) is to decide jurisdictional issues presented by the fact that the proposed facility is both producing electricity and manufacturing wood pellets. The schedule is as follows:
  • 1/14/2011: Jurisdictional Brief Due from BWE
  • 2/7/2011: Non-petitioners' responses due (Non-petitioners are all parties to the case who are not BWE)
  • 2/14/2011: BWE reply due

Party Status: The Town of Pownal Board of Selectmen and the Bennington County Regional Commission have been granted party status. Read about what that means here.

These updates are found in a 12/23/2010 ruling by the Public Service Board on a petition by Beaver Wood Energy to stay the dockets and reconsider the prehearing conference memorandum. The PSB denied the motions. A second order on party status was issued 2/3/11.

Documentation of Petition for Preliminary Approval - On Nov. 19th the Public Service Board held a hearing that included Beaver Wood Energy's request for preliminary approval of early construction work on its biomass facility.
